These Terms and Conditions ("Terms") govern the use of the Growth Engine service provided by Inspirational Change Pty Ltd (ABN 94 163 286 084), trading as Breakthrough Media, under the brand BuilderConnect ("we", "us", "our"). By using our services, you ("the Client") agree to these Terms.
1. Overview of Services
BuilderConnect delivers digital marketing services for renovation businesses. This includes setup, management, optimisation of marketing campaigns, and access to technology designed to assist with lead generation and follow-up.
2. Client Responsibilities
Clients agree to provide accurate business information, branding assets, and service details in a timely manner.Respond promptly to new leads.Participate in strategy or setup sessions as required.Maintain consistent advertising activity throughout the campaign.Understand that lead generation is our responsibility; quoting, follow-up, and sales conversion are the client's.
3. Ad Spend and Platform Access
Clients are responsible for funding their own advertising campaigns directly with the platform provider (e.g. Meta™). We retain the right to adjust service structure based on campaign complexity or advertising activity.
Platform access (including CRM, automations, and campaigns) remains active throughout the service period. Maintenance terms may apply in the event of paused campaigns.
4. Lead Guarantee (When Applicable)
Where applicable and agreed in writing, BuilderConnect may offer a lead volume guarantee tied to sustained advertising activity over a defined period.
In such cases, if the agreed volume is not met, additional campaign management may be provided at no extra cost (excluding advertising spend) until the minimum lead commitment is fulfilled.
5. Confidentiality and Intellectual Property
All systems, strategies, copy, automation frameworks, and campaign assets remain the exclusive property of BuilderConnect. Clients are granted access only for the duration of the service. Materials may not be copied, reused, or distributed without written permission.
6. Non-Solicitation and Fair Use
Clients agree not to solicit, engage, or hire BuilderConnect personnel, contractors, or partners outside of this agreement. Clients also agree not to use BuilderConnect’s proprietary systems or frameworks to compete with our services, during or after the agreement.
7. Liability and Disclaimer
BuilderConnect is not responsible for business outcomes, sales performance, or missed opportunities. The Client accepts responsibility for lead response times, follow-up, and sales process.
8. Termination and Notice
Service terms and cancellation procedures are defined in the individual service agreement. Written notice is required to make changes or terminate services.
9. Electronic Communication
All notices and correspondence will be delivered via email and are considered binding once received by the appropriate contact.
10. Entire Agreement
These Terms reflect the full understanding between BuilderConnect and the Client regarding the use of services. Any changes must be agreed to in writing.
